1. General provisions
1.1. This offer is an official offer “oldkhataproject.com”, hereinafter referred to as “Seller”, to conclude the Agreement for the purchase and sale of goods remotely, i.e. through an online store, hereinafter referred to as “Agreement”, and places a Public Offer (proposal) on the official website of the Seller “https://oldkhataproject.com” (hereinafter referred to as “Internet site”).
1.2 The moment of full and unconditional acceptance by the Buyer of the Seller’s offer (acceptance) to conclude an electronic contract of purchase and sale of goods is considered the fact of payment by the Buyer of the order on the terms and conditions of this Agreement, in terms and at prices specified on the Seller’s website.
2. Concepts and definitions
2.1. In this offer, unless the context requires otherwise, the following terms have the following meanings:
A Site Visitor is a person who visits the website oldkhataproject.com without the purpose of placing an Order.
The user is a natural person, a visitor to the Site, who accepts the terms of the agreement and who wants to place an Order on the website oldkhataproject.com.
Buyer – User who placed an Order on the website oldkhataproject.com with the purpose of purchasing goods for personal use.
The seller is an individual entrepreneur, the owner of the goods presented in the online store
Online store – an Internet site located on the Internet at the address oldkhataproject.com, which presents the Goods offered by the Seller for purchase, as well as the terms of payment and delivery of the Goods to Buyers.The website is oldkhataproject.com.
3. Subject of the Agreement
The Seller undertakes to transfer the Product into the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Product on the terms and conditions of this Agreement.
This Agreement regulates the purchase and sale of Products at the online store, including:
– voluntary choice of goods by the Buyer in the Internet-shop;
– independent execution of an order by the Buyer in the Online store;
– payment by the Buyer for the order placed in the online store;
– processing and delivery of the Buyer’s order to the Buyer’s ownership on the terms of this Agreement.
4. Order of registration of the order
4.1. The Buyer has the right to place an order for any Product presented on the Website of the Online store and available.
4.2. Each item may be presented in the order in any quantity.
4.3. If the Products are out of stock, the Company Manager must notify the Buyer (by phone or e-mail).
4.4. In the absence of products, the Buyer has the right to replace it with products of the same model, to refuse these goods, to cancel the order.
5. Order Delivery
5.1. The goods are formed and delivered by the postal operator in the form of a postal shipment only after the Buyer has paid in full for his Order, or using the option of payment upon receipt at the New Post office.
5.2. The territory of delivery of the Goods presented on the Site is limited
6. Order of payment for the order
6.1. Delivery of goods purchased in the online store is carried out to the warehouses of transport companies, where the orders are issued.
6.2. Together with the order the Buyer is provided with the documents according to the legislation of Ukraine.
7. Rights and obligations of the parties:*.
The Seller has the right:
unilaterally suspend the provision of services under this contract in case of violation of conditions of this contract by the Buyer.
7.2. The Buyer is obliged:
pay for and receive the order in time on the terms of this contract.
7.3. The Buyer has the right:
place the order in the Online store;
make out an electronic agreement;
demand performance of the terms and conditions of this Agreement from the Seller.
8. Responsibility of the parties
8.1. Parties are responsible for non-fulfillment or improper fulfillment of conditions of the present agreement in the order foreseen by this agreement and the current legislation of Ukraine.
8.2. The Seller is not responsible for:
* the appearance of the Product changed by the manufacturer;
* for insignificant nonconformity of the color scheme of the Product, which may differ from the original of the Product only due to different color transmission of personal computer monitors of certain models;
* for the content and truthfulness of the information provided by the Buyer when placing the order;
* for delays and interruptions in the provision of Services (order processing and delivery of products), which occur for reasons beyond its control;
* for illegal illegal actions carried out by the Buyer by means of this access to the Internet;
* for the transfer by the Buyer of its network identifiers – IP, MAC address, login and password – to third parties;
8.3. The Buyer, using the Internet access provided to him, is independently responsible for the damage caused by his actions (personally, even if there was another person under his login) to persons or their property, legal entities, the state or moral principles of morality.
In the event of force majeure circumstances, the parties are released from compliance with the terms and conditions of this agreement. The force-majeure circumstances for the purposes of the present contract are understood to mean the events having extraordinary, unforeseen character, which exclude or objectively prevent the fulfillment of the present contract
8.5. The parties shall make every effort to resolve any differences solely through negotiations.
9. Other conditions
9.1. The online store reserves the right to unilaterally amend this contract, subject to prior publication on the website https://oldkhataproject.com
9.2. The online store is designed to provide a remote way to sell products online.
9.3. The buyer is responsible for the reliability of the information specified when placing an order. Thus, at realization of the acceptance (order registration and the subsequent payment of the goods) the Buyer gives to the Seller the unconditional consent to gathering, processing, storage, use of the personal data, in understanding the Law of Ukraine “About protection of the personal data”.
9.4. Payment by the Buyer of the order executed in the online store means the Buyer’s full consent to the terms of the contract of sale (public offer).
9.5. The actual date of the electronic agreement between the parties is the date of adoption of the terms, in accordance with Article 11 of the Law of Ukraine “On Electronic Commerce”.
9.6 The use of the Online Store resource for previewing the products, as well as for ordering is free for the Buyer.
9.7. The information provided by the Buyer is confidential. Online Store uses information about the Buyer only for the purposes of order processing, sending notifications to the Buyer, delivery of goods, making settlements, etc.
10. The order of return of products of proper quality
10.1. Return of products to the Online Store is made in accordance with the current legislation of Ukraine.
10.2. The return of products to the Online Storeis made at the expense of the Buyer.
10.3. When the Buyer returns the goods of proper quality, the Online Store refunds the amount of money paid for the goods on the fact of returning the goods minus compensation for the expenses of the Online Store associated with the delivery of goods to the Buyer.
11. Term of the agreement
11.1.An electronic contract shall be deemed to have been concluded from the moment of receipt by the person who sent a proposal to conclude such a contract, a reply on acceptance of such proposal in the order determined by part six of article 11 of the Law of Ukraine “On Electronic Commerce”.
11.2 This Agreement may be terminated by mutual consent of the parties prior to the actual delivery of goods, by way of return of funds
11.3. The Parties have the right to terminate this Agreement unilaterally, in case of non-fulfillment of conditions of this Agreement by one of the Parties and in cases stipulated by the current legislation of Ukraine.
